Construction Note
No Trespassing and Cutoff Date
To all members that are rebuilding or renovating, please note that you should not use a neighbor's driveway, electric, etc, without their direct permission. We have already had reports this winter of a builder placing a dumpster in a neighbor's driveway, using the electric from another house, and using someone else's barbecue. Contractors are parking trucks in other driveways, and making a real mess out of the stones, and creating ruts with the large tires.
Let's all be neighborly and considerate during construction projects. Please advise your builders and subcontractors that they may NOT use someone else's driveway, electric, etc, with first contacting that member for their permission. Also, visit your site frequently throughout construction to ensure that the builder is adhering to the above, and that the site is neat and free of unnecessary construction debris.
Finally, remind your general contractor that all construction must cease on June 15th. This is a hard deadline, and must be met. No exceptions will be granted. No banging, sawing, or other noise making activity may take place, and all construction material, commercial vehicles, and debris must be removed from the property. The only interior work that may be conducted is painting.
Please keep in mind that we have guests that pay a lot of money to rent in our community, and should not be bothered with construction related noise, debris, and construction vehicles. It is up to the member to communicate this deadline with the builders and subcontractors, and to ensure that they will meet it. If the deadline is not met, construction must cease, and may resume the Saturday after Labor Day.
Membership Dues
Dues invoices were mailed to you at the end of December. If you have not received yours, please contact Jean Johnson through this website by clicking on "Contact Us" and sending an email, or call Jean direct at 732-492-0756. Another copy will be emailed or mailed to you.
This year's dues are $567.00 and is due February 1. Interest and penalty will accrue on March 31st if your dues bill is not paid, so be sure to take care of this as soon as possible.

Giblin Lawsuit
260 Harbor Drive
The Giblin lawsuit has been resolved. The Giblins sued the Club to have their home recognized as an existing two story home. The Judge and zoning experts determined that the home was not one of the original two story homes, but rather a colonial style 1 1/2 story that pre-dated the formation of the Club. After much discussion regarding the height of the new structure, both parties agreed to a 23' height. The front half (street side) of the home will meet the 19' height limit for one story homes, and the back half of the home will be 23' high. All setback requirements have been met.
The house was torn down recently, and the new construction must cease on June 15th.
Peg Porter
It is with great sadness that we report the passing of long time member and dear friend Peg Porter. Peg has been battling a recent illness, and passed away at home last evening, 1/4. Peg's dear friendship, kindness and caring will be missed by all. She was such a special lady that contributed so much to our community over the years. Our thoughts and prayers are with Port and his family.

Obituary
Peggy Baarck Porter died Wednesday, Jan. 4, 2012 after a difficult battle with lung cancer. Peggy was born in Weehawken, NJ and grew up in Allendale, NJ. Her parents were Anne and Werner Baarck. Peggy's engaging personality won her friendships wherever she went. She graduated from Ramsey High School, Ramsey, NJ, was very active in school's activities and was elected "Miss Ramsey High" and served as the school's "Head Cheerleader." Peggy attended Douglas College in New Brunswick where she met and married Carroll "Port" Porter. They were married for 61 years and had three children, three grandchildren and one great granddaughter, daughters, Jennifer Porter and her companion Laura Matarazzo, Carol Steeneck and her husband Brian; son, Steve Porter and his wife Barbara "Tish;" grandchildren, Lauren Pettorossi and Mark, Allison Jungkind and Steve, Stephen Porter Jr.; great granddaughter, Jayda Pettorossi.
Peg and Port lived in Allendale, NJ for forty years where she was busy with family, President of the Junior Woman's Club and active in the Holiday Observer Events. She worked as Office Manager for Dr. Elias Tsoukas, Ramsey, NJ for over 20 years. Peg and Port retired to the Jersey Shore in 1990 where she became involved in the Ocean Beach and Yacht Club, serving as Special Events Chairperson, arranging dinners, dances and other events.
The family will receive friends Saturday, January 7, 2012, 2-4 & 7-9pm at the Timothy E. Ryan Home for Funerals, 706 Grand Central Ave., Lavallette, NJ then Sunday, January 8, 2012, 5-8pm at the Van Emburgh-Sneider-Pernice Funeral Home, 109 Darlington Ave., Ramsey, NJ. A funeral service will be conducted on Monday, January 9, 2012 at 12:00noon at the funeral home for family only. Interment to follow at George Washington Memorial Park, Paramus, NJ. In lieu of flowers, donations may be made to OBYC Special Events, PO Box 92, Lavallette, NJ 08735 or Grace Healthcare Services, 105 Fieldcrest Ave, Suite 304, Edison, NJ 08837-3628. Harbor Drive Flooding Update
Several engineers and surveyors have been seen working near the park. It appears that we may finally see some action with the endless street flooding near the park. We'll keep you posted...
House Raising Assistance
Increased Cost of Compliance (ICC)
For those homeowners with flood insurance, you may receive money to help offset the cost of raising your home if it was flooded. If your policy contains an ICC clause, or Increased Cost of Coverage, here is some important information that you will need to submit your claim.
If the damage to the home exceeds 50% of the assessed value of the structure, there is a standard letter that FEMA and your insurance carrier need from the township.
Anyone who is considering putting in a claim under the ICC clause, and thinks that they may want to raise their home above the base flood elevation, should email or visit Bob Chankalian at Toms River Township with a copy of an estimate by a contractor to repair the current flood damage only. Bob will compare the estimate to the assessed value, and if it is over 50% of the assessed value, which all have been so far, Bob will email the required FEMA ICC letter to you usually within a day.
The ICC letter basically means that it is in FEMA's best interest to pay to raise the home since the current damage and future damage will probably cost more than the cost of raising the structure. One of our members is receiving a $20,000 FEMA grant for raising their home.

Expedited Town Permits
If you will be doing any construction that requires a town permit, Toms River has agreed to expedite the permit process for you. Keep in mind that you still need a Club permit before applying for a town permit.

Federal Disaster Relief
Update 9/5/11 - 8:00pm
A member was able to successfully submit a FEMA disaster relief claim today. It appears as if Ocean County has also been added to the list of areas eligible for federal disaster relief.

I am writing because you have corresponded with me in the past, and I want to provide you with a critical update on Federal Government disaster assistance that is available for New Jersey residents harmed by Hurricane Irene. If you yourself have not suffered damage, please forward this information to any family or friends who may need assistance.
Yesterday, President Obama issued a Major Disaster Declaration for damage resulting from Hurricane Irene in our state, which makes many New Jersey residents eligible for a number of Federal disaster relief programs. These programs offer grants and loans to individuals and loans to businesses. The Federal Government has set up a website that allows people to apply online for assistance:

This website consolidates the application process across several Federal agencies, including FEMA and the Small Business Administration. The website also reduces the number of forms you will ultimately have to fill out, shortens the time it takes to apply and allows you to check the progress of your applications online. If you want to apply by phone rather than the Internet, you can call 1-800-621-FEMA (1-800-621-3362).
While the damage suffered across New Jersey is devastating, I know our state can rebound quickly. Federal aid will play a crucial role in our recovery, so please take advantage of the resources available. Please don't hesitate to contact me anytime regarding this or other issues.
Flooding Petition
A petition was created for the Harbor Drive and Rt 35 South daily flooding problem. The petition has been available at various events, and is available at the clubhouse. Please take a moment and sign the petition so that we may send it to the township and NJ DOT. You may also sign the petition at ice cream night and at the General Membership meeting on Saturday.

If your shed was damaged by the storm, please keep in mind that you will need a shed permit before purchasing a new one. Also, please refer to the Rules & Regulations for shed size restrictions. Keep in mind that if you had a non-confirming shed that needs replacing, the new shed must comply with the current restrictions.

Important Notice
Please be advised that animals are not permitted on our beaches at any time, year round, per Toms River ordinance 1411. Animals are also not permitted at any time on the clubhouse property, which includes the entire parking lot and bay beach. Your cooperation is greatly appreciated!

Garbage & Recycling News
The Township is changing all collection days for recycling. Recycling will be collected twice-a-month September through May and weekly from June 3rd through September 2nd.
There will be a third collection in May on May 31st, 2011. During the twice-a–month collection period, if you generate more recyclables than fit into your recycling can, you can call (732-255-1000 ext. 8119) for an extra pickup, no later than Thursday before 2:30 p.m. The extra recyclable material will then be picked up on the Friday following your call.
Your garbage collection will continue to be picked up on Mondays during the once-a-week schedule and Mondays and Thursdays during the twice-a-week schedule, which will start the week of July 4th and end on September 1, 2011. McKinney Rooftop Deck
Club Wins in Appellate Division
June 2011
On November 20, 2009, Judge Frank Buczynski ruled in the Club's favor regarding our motion to enforce the already agreed upon settlement to have the McKinney's remove the rooftop deck railing and staircase. However, the McKinneys chose to appeal the Judge's decision.
On March 22, 2011, the Appellate Division of the Superior Court of NJ affirmed Judge Buczynski's prior decision. Yet again, the McKinneys appealed, but to the NJ Supreme Court. They later withdrew their appeal and must now comply with the prior settlement agreement and remove the railing and staircase.
McKinney Defamation Suit Dismissed
The lawsuit filed by Dr. and Mrs. McKinney against Dean Hansen, Jack O'Leary, and OBYC was dismissed in its entirety by the court on January 22, 2010.

Nisch, Vodraska, Xavier Suit Dismissed
The two story lawsuit filed against the Club and Board by Ken & Joan Nisch, Frank Vodraska, and Frank Xavier has been dismissed on 12/4/09. In summary, the Judge ruled that the Club's building height restrictions are legal and enforceable, and that the Board acted appropriately in enforcing the height restrictions.

Support a Single Barrier Island Community
As we all know, the various barrier island communities have been hit hard with the recent property tax increases. Most homeowners have seen at least a 50% increase in their taxes, with some experiencing a 100% increase. Toms River is using this area, mostly made up of non-voting homeowners, as a cash cow to subsidize the mainland properties. We must take action now to prevent further increases, and to encourage our legislators to pass Sen. Kyrillos' bill, SJR13, to create a single barrier island community. We have very specific and unique needs as compared to the mainland, yet those needs are continually ignored by Toms River. We need to combine communities and share services, which should lower our property taxes. Let's stop the shakedown by Toms River, and finally get the services that we deserve at a reasonable tax rate!

Movies on the Beach
OBYC is extremely grateful for the Stephanie Zagata Neglia Memorial donation of the outdoor movie screen and equipment. Thanks to Stephanie's family and generous donations by our members, families can now enjoy childrens movies on the beach. If you haven't been to one of the movie nights, you really should make a point of joining us for the next movie. The jumbo screen and sound system are spectacular! A perfect way to spend the evening with the family.
